Pre-hearing notification - peanut allergy case

Cheshire West and Chester Council has prosecuted the owner of an unsafe food business.  The defendant, Layekul Islam (60), is the owner of Balti Cottage Indian restaurant at Over Square in Winsford.  He pleaded guilty to the following offences under regulation 19 of the Food Safety and Hygiene (England) Regulations 2013, concerning:
  1. Selling unsafe food from the restaurant – a takeaway meal containing peanut was eaten by an eleven year old boy who had a peanut allergy with adverse, but non-fatal effects.
  2. The presence of cockroaches in the restaurant.
  3. Failing to keep the restaurant clean.
Following a hearing at Chester Magistrates Court on 17 October, when the magistrates decided the case was too serious for them to deal with, a sentencing hearing will now take place at Chester Crown Court on Thursday 14 November 2019.
